PHARMCUBE PRIVACY POLICY

It is Pharmcube Group Co., Ltd's (“the Pharmcube” “We” or "us") Privacy Policy ("the Policy") to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you, including across our Official Website, www.pharmcube.com, other sites and WeChat official Account and Mini Programs we own and operate.

The Policy applies to the relevant products and services ("the Service") provided to you by Pharmcube. For the avoidance of doubt, you should be aware that the Pharmcube also includes branches and all wholly-owned subsidiaries of Pharmcube Group Co., Ltd. 

Please carefully read and fully understand all contents of the Policy, especially those marked in bold font, before using the Service. Once you choose "I accept" or otherwise agree to use the Service, it is deemed that you agree to comply with all the terms of the Policy and agree us processing your personal information in accordance with legal and regulatory requirements. If you DO NOT agree to any provisions of the Policy, please DO NOT  register or use the Service.

1. Collection And Use Of Personal Information

1.1 "Personal Information" refers to all kinds of information recorded electronically or in other ways and related to identified or identifiable natural persons, but does not include the information that has been anonymized.

1.2. Collection and Use: In order to better provide you with services, Pharmcube will follow the principles of "legality, legitimacy, and necessity", collect your personal information in accordance with laws and regulations and with your consent, mainly including: personal information provided when you register as a user or relevant personal information provided to Pharmcube when using the services provided by Pharmcube. If you do not provide or agree to our collection and use of such personal information, it may result in our related products or services not functioning properly, or we will be unable to provide you with related products and services. The specific channels, scenarios, and functions through which we collect and use personal information include:

(1) Pharmcube Official Website (www.pharmcube. com)

• When you choose to apply for a trial on the Pharmcube Official Website, we will collect your name, email address, phone number, company name, department name, title, city and your needs to assist you in completing the application.
• When you log in to the Pharmcube Official Website through WeChat, we will collect your WeChat Open ID, and Union ID to assist you in logging in and using the Service.
• When you browse the Pharmcube Official Website, we will collect your first login IP address information, user browsing behavior on the website and browser information.
• When you use the hotline reserved on the Official Website of Pharmcube to contact us, we may collect the information you proactively provide us with, as well as personal information related to the Service, in order to provide you with corresponding pre-sales and after-sales services.

(2) Pharmcube WeChat Mini Program

When you use our WeChat  Mini Program (including "Drug Data PharmaGO", "Medical Report ByDrug", "Global New Drug NextPharma", "Global New Drug Venture Capital-MedAlpha", and "Medical Venture Capital Intelligence InvestGo") to complete the registration/login process, we will collect your phone number, WeChat Open ID and Union ID to assist you in completing the registration/login process.

(3) Pharmcube WeChat Official Account

• When you use our WeChat Official Account (including "Pharmcube", "PharmcubeInfo", "PharmcubeMed", "PharmcubePro", "PharmcubeInvest", "PharmcubePlus") to apply for a trial, we will collect your name, company and  department name, title, phone number, email address, and the product you most want to know about the trial to help you complete your application.
• When you follow our WeChat Official Account and browse our published content, we will collect your WeChat nickname, WeChat avatar, Open ID and Union ID for internal analysis of reader groups and their preferences to improve our service quality.
• When you post your resume through the email address published on the "PharmcubeHR" WeChat Official Account, we will collect your resume information and other personal information you actively provide. For the collection of personal information of candidates, please refer to our Applicant Privacy Policy.

(4) Online Form Tools

We may assist other companies in collecting your relevant personal information through online form tools such as QuestionStar, Golden Data, Mack, XiaoE Tech, Beschannels and Willing which may include your name, phone number, email address, company name, title, research field/direction, which cutting-edge technologies and companies you are interested in, and what topics you are looking forward to reporting on. We may use those information to advertise product information, notify online/offline event information through SMS/email/Wechat Official Account, or improve media service quality, etc.

(5) SendCloud 

SendCloud is an email sending service software that we purchased from a third-party service provider, which is designed to send product/service information and event notifications by email or phone message to you. We will collect your email IP address, cookie information (including actions such as whether you open the email, whether you unsubscribe from the email, whether you put the email in a junk email box, etc.) for analyzing the marketing effect. If you do not wish to receive this kind of email or phone message, you can unsubscribe via the unsubscribe option in the email or phone message. However, if you choose to unsubscribe, we may not be able to provide some services to you. Therefore, we recommend that you retain your subscription so that you can better receive real-time information.

2. Purpose And the Legal Ground

2.1 Legal ground for processing your personal information

We ensure that the processing of your personal information complies with applicable laws and regulations, and is processed based on the following legal ground:

• Based on your consent, which is voluntarily and explicitly made with your full knowledge (if any other legal ground below applies, we may process your personal information without your consent);
• We need to process your personal information in order to enter into and fulfill the contract to which you are a Party;
• Necessary for fulfilling legal duties or obligations;
• Necessary for responding to sudden public health emergencies or in emergency situations to protect the life, health, and property safety of natural persons;
• Conduct news reporting, public opinion supervision, and other activities for the public interest, and process your personal information within a reasonable range;
• The personal information we process is information that you disclose on your own or legally disclose through other channels; or
• The legal ground for processing personal information as stipulated by laws and administrative regulations.

2.2 Unless permitted by applicable laws and regulations, we will not use your personal information for any other purpose. When Pharmcube intends to use information for other purposes not specified in the Policy, it will seek your consent in advance.

3. Sensitive Personal Information

3.1 "Sensitive Personal Information" refers to personal information that, once leaked or illegally used, can easily cause harm to the personal dignity or personal and property safety of natural persons, including biometrics, religious beliefs, specific identities, medical health, financial accounts, travel trajectories, and personal information of minors under the age of fourteen.

3.2 For the purpose stated in Part 2, we have not involved collecting sensitive personal information from you.

4. Entrusted Processing, Sharing, Transfer, and Public Disclosure 

4.1 Entrusted processing

For the purposes stated in the Policy, we may entrust a third party (the "trustee") to process your personal information on behalf of Pharmcube, such as, System operation and maintenance service provider, software development service provider, data analysis service provider or communication service provider. These trustees have a confidentiality obligation towards your personal information and may only use it for the purposes described in the Policy. We will require the trustee to strictly comply with our measures and requirements for personal information and privacy protection, including but not limited to processing personal information in accordance with the relevant service agreements between the trustee and us.

4.2. Sharing

Pharmcube will not share your personal information with any third-party companies, organizations, or individuals outside of our company and its affiliated companies, except for the following situations:

• Can be provided in accordance with the terms of the Policy or other service agreements, online terms, and other regulations between you and Pharmcube;
• You agree that Pharmcube shares your personal information with other parties;
• In accordance with laws and regulations or the mandatory requirements of the competent government authorities.

4.3 Transfer

Pharmcube will not transfer your personal information to any third party company, organization, or individual, except for the following situations:

• Can be provided in accordance with the terms of the Policy or other service agreements, online terms, and other regulations between you and Pharmcube;
• You agree that Pharmcube transfers your personal information to other parties;
• In the merger, split, acquisition or bankruptcy liquidation of Pharmcube and its affiliated companies, if personal information transfer is involved, Pharmcube will require the new companies or organizations that hold your personal information to continue to be subject to the relevant provisions of the Policy, and will require it seek authorization and consent from you again.

4.4 Public Disclosure

Pharmcube will only publicly disclose your personal information in the following situations:

• Can be provided in accordance with the terms of the Policy or other service agreements, online terms, and other regulations between you and Pharmcube;
• Obtain your explicit consent;
• According to laws, legal procedures, litigation, or mandatory requirements of government authorities.

5. Preservation and Protection

5.1 Storage location: 

Your personal information will be stored within China. If we need to transmit your personal information overseas, we will obtain your explicit authorization separately and fulfill legal obligations in accordance with effective Chinese applicable laws and regulations, and ensure sufficient protection of your personal information in accordance with the Policy.

5.2 Retention Period: 

Unless extended with your consent or permitted by law, Pharmcube will only retain your personal information for the period required to achieve the purposes stated in the Policy.

5.3 Safety protection measures

• Pharmcube will strictly comply with the requirements of the Cybersecurity Law, Personal Information Protection Law, and other relevant laws and regulations, and take technical and other necessary measures to protect the security of your personal information. We will establish a comprehensive management system using various security technologies and procedures to protect your personal information from unauthorized access, use, or disclosure. However, due to technological limitations and various possible malicious means, Pharmcube cannot guarantee the absolute security of your personal information.
• After a personal information security incident occurs, Pharmcube will promptly inform you in accordance with legal and regulatory requirements of the basic situation and potential impact of the security incident, the disposal measures that Pharmcube has taken or will take, suggestions that you can independently prevent and reduce risks, and remedial measures for you. Pharmcube will promptly inform you of the relevant situation of the event through email, phone, and other means. When it is difficult to inform individual information subjects one by one, Pharmcube will take reasonable and effective measures to publish announcements. At the same time, Pharmcube will also proactively report the handling of personal information security incidents in accordance with regulatory requirements.

6. What Legal Rights Do You Have Regarding Your Personal Information

For your personal information processed by Pharmcube, you have the following personal information rights:

(1) Access: You have the right to access your personal information held by us.

(2) Reproduction: Within the scope permitted by applicable laws, you have the right to request the reproduction of your personal information from us.

(3) Correction and supplementation: You have the right to request us to correct or supplement your inaccurate or incomplete personal information.

(4) Deletion

In the following situations, you can request the deletion of personal information from Pharmcube: 

• If the behavior of Pharmcube in processing personal information violates laws and regulations; 
• If Pharmcube collects and uses your personal information without your consent; 
• If the behavior of Pharmcube in processing personal information violates the agreement with you; 
• If you no longer use the Service, or 
• if you cancel your account; 
• If Pharmcube no longer provides you with any services. 

However, please note that even if you request us to delete your personal information before the expiration of the retention period stipulated by applicable laws and regulations, we still have the right to save this information;

(5) Withdrawal of consent

You have the right to request the withdrawal of your consent regarding the personal information we collect and process based on your consent. If you withdraw your consent, it does not affect the effectiveness of our personal information processing activities based on your consent before the withdrawal. But please note that even if you withdraw your consent, we may still have the right to process your personal information based on other legitimate grounds;

(6) Refusal or restriction of processing

In specific circumstances, you have the right to request us to stop or restrict the processing of your personal information. In certain circumstances, when you request us to restrict the processing of your personal information, we may have the right to refuse the request in accordance with the law;

(7) Request for Interpretation

You have the right to request us to provide an explanation of the rules for processing personal information;

(8) When we make decisions that have a significant impact on your rights through automated decision-making, you have the right to request clarification from us and the right to refuse us to make decisions solely through automated decision-making; as well as

(9) Complaint and reporting

You have the right to file a complaint or report to the personal information protection agency regarding illegal personal information processing activities.

8. Update of the Policy

Pharmcube has the right to unilaterally modify the content of the Policy at any time and publish it through web announcements or other means.  Once you choose "I accept" and continue to use the Service or otherwise, it is deemed that you have fully read, understood, and accepted the revised content of the Policy, and will use the Service in accordance with the revised Policy. If you DO NOT agree to the modification of the Policy, you should contact Pharmcube promptly.
